General Terms and Conditions of Sale

PREAMBLE

The website https://eclairagefrancais.fr is published by the company L&L4S, a simplified joint-stock company with a sole shareholder, registered with the Paris Trade and Companies Register under number 941 794 141, located at 9 rue des Colonnes, 75002 Paris (France).

These General Terms and Conditions of Sale ("GTCS") govern, without restriction or reservation, all sales concluded between L&L4S (the "Seller") and any person, consumer or professional, wishing to purchase the products offered on the site (the "Customer").
The Order Confirmation + the GTCS form the sales contract. Any order implies full and complete acceptance of the GTCS in force on the day of the order.
L&L4S reserves the right to modify the GTCS; the new provisions apply to orders placed after they are posted online.

ARTICLE 1 – DEFINITIONS

The terms and expressions identified by a capital letter in these GTC (whether used in the singular or plural) have the following meanings:

- "General Terms and Conditions of Sale" or "GTC": this document, which governs the contractual relationship between L&L4S and the Customer;
- "Order": the Customer’s purchase order for one or more Products placed on the Website or with Customer Service;
- "Website": the site accessible at the address https://eclairagefrancais.fr (as well as any URL succeeding it);
- "Product": any lighting fixture or accessory offered for sale on the Website;
- "Customer": any natural or legal person, acting in a professional capacity or otherwise, who places an Order after having accepted the GTC.

ARTICLE 2 – PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of L&L4S (the "Seller") and the Client in the context of the sale of the Products offered on the Website.

The T&Cs are permanently available at the following address: https://eclairagefrancais.fr/pages/conditions-generales-de-vente

and may be downloaded or printed by the Client.

Placing an Order on the Website is reserved for adults with full legal capacity. By validating their Order, the Client declares that they possess this capacity and acknowledges having read and accepted the T&Cs.

ARTICLE 3 – ACCOUNT CREATION

To order Products on the Website, the Customer must create an account by providing accurate information (surname, first name, e-mail address, password). The Customer guarantees the authenticity and currency of this data and undertakes to update it.

The Customer chooses a confidential username and password, which they must not disclose to third parties. They remain responsible for any action performed using these credentials until their potential deactivation.

Any fraudulent use or whimsical personal information that is contrary to public policy or infringes upon the rights of third parties may result in the suspension or closure of the account by L&L4S, as well as the cancellation of pending Orders.

The Customer shall inform L&L4S without delay of any unauthorized use of their account or any breach of the confidentiality of their credentials.

ARTICLE 4 – ORDERING PROCEDURES

4.1 Online Ordering

The Client places their Order — in French — exclusively on the Website, after identifying themselves or creating an account (see art. 3).

4.2 Ordering process

The steps appear successively on the screen:

- Adding selected Products to the cart
- Reading and accepting the GTC → click "Proceed to payment"
- Identification (login or account creation)
- Entry of delivery and, if applicable, billing addresses
- Choice of delivery method and payment method – display of the summary
- Validation by clicking "Pay now" (secure payment via Stripe)
- Order confirmation email containing the summary and the link to the GTC

4.3 Verification before validation ("double-click")

In accordance with Article 1127-2 of the Civil Code, the Client may check the details of their Order, its total price, and correct any errors before the final click.
L&L4S cannot be held responsible for entry errors attributable to the Client (address, quantities). Any re-shipping costs due to such errors remain the responsibility of the Client.

4.4 Effect of the "Pay" click

By clicking on "Pay for my order", the Client:

- confirms the content of their cart and the total price;
- declares that they accept the GTC without reservation;
- commits to paying for the Order.

Validation constitutes the formation of the contract; the Client immediately receives the acknowledgement of receipt, followed by the order confirmation summarizing the purchased Products, the price paid, and the link to the PDF version of the GTC.

 

ARTICLE 5 – ORDER CONFIRMATION

5.1 Final formation of the contract

The Order is only considered final upon the sending of the "Order Confirmation" email issued by L&L4S to the Customer. The sale only becomes effective after full receipt of payment by the Seller.

5.2 Validity of offers

The Products and prices displayed on the Website are valid as long as they appear there; the catalog is updated daily.
Offers are subject to available stock. Any promotional operation shall specify its validity period.

5.3 Product unavailability

If an ordered Product proves to be unavailable (production stoppage, supplier stockout, etc.), L&L4S shall inform the Customer by email as soon as this is identified. The Customer will then be offered:

  • either the new availability lead time;
  • or, where applicable, an equivalent Product of comparable quality and price.

In the event that the Customer refuses to wait or to opt for the equivalent, L&L4S shall refund the price already collected within 15 days of confirmation of the refusal.

5.4 Right of refusal for legitimate reason

In accordance with Article L.121-11 of the Consumer Code, L&L4S may refuse or cancel any Order for a legitimate reason: payment issue, doubt regarding the identity or good faith of the Customer, abnormal quantities, foreseeable delivery difficulty, etc.
The Seller may also request supporting documents (copy of ID, proof of address). Failing a response or in the event of the Customer’s refusal, the Order will be cancelled and, if applicable, refunded.

Similarly, L&L4S reserves the right to cancel an Order when the displayed price is the result of a manifest error (technical bug, malfunction, negligible price not in line with the actual value of the Product).

ARTICLE 7 – PAYMENT

7.1 Price exigibility

The total price of the Products including all taxes, covering logistical preparation and delivery costs, is payable in full at the time of Order validation.
This payment is not considered a deposit (art. L214-1 of the French Consumer Code).

For shipments outside the European Union, the Customer agrees to pay any applicable customs duties, import taxes, or local VAT directly to the carrier or customs authorities.

7.2 Payment methods offered

For consumers: payment is made by credit card (Visa, Mastercard, American Express, Apple Pay) via the Stripe gateway. All transactions are encrypted (TLS/SSL protocol) and subject to the strong customer authentication required by PSD2 (3-D Secure).

For professionals:
– either by bank transfer to the account indicated on the quote, prior to shipment;
– or, if they wish, by credit card via Stripe under the same security conditions as above.

The Customer declares that they are the holder of or duly authorized to use the chosen payment method and that they have sufficient funds. Any payment order by card is irrevocable upon confirmation, without prejudice to the right of withdrawal (art. 10).

The Customer's account is debited immediately after the transaction is validated.

7.3 Non-payment – Retention of title

The Products remain the property of L&L4S until full payment is received (cf. art. 8).
In the event of non-payment, L&L4S may:

- suspend or cancel the Order;

- reclaim the Products at the Customer's expense;

- demand late payment penalties (see Appendix 1 for professionals).

The transfer of risk nevertheless occurs upon physical delivery (consumers) or upon handover to the first carrier (professionals).

7.4 Transaction security

Online payments are processed by Stripe, a PCI-DSS Level 1 certified provider; no card data is stored by L&L4S. All information exchanged is encrypted (TLS 1.2+), ensuring the confidentiality of banking data.

ARTICLE 8 – PRODUCT DELIVERY

8.1 Delivery zones and locations

The Products are delivered to the address indicated by the Customer when placing the Order.
L&L4S serves the destinations specified on the "Delivery" page of the Site (https://eclairagefrancais.fr/livraison). No delivery is made outside of this zone without prior written agreement.

8.2 Delivery times

The estimated time is displayed to the Customer before validation and payment.
Except for specific lead times announced on the Product page (e.g., Made-to-Order 2 – 12 weeks), the maximum delivery time shall not exceed sixty (60) business days from the Order Confirmation.

In case of delay:

2- the Customer may formally request that L&L4S deliver within a reasonable additional period;
1- failing this, they may terminate the contract in accordance with Article L216-6 of the French Consumer Code and obtain a refund within fourteen (14) days, unless the delay is attributable to the Customer (unavailability, address error, etc.).

8.3 Availability / transfer of risk

Delivery is deemed to have taken place when the package is delivered to the agreed address or, in the event of absence, upon its availability by the carrier (pickup point, warehouse, new appointment).
Risks are transferred:

  • to consumers: upon physical delivery;
  • to professionals: upon handover to the first carrier.

8.4 Receipt and reservations

Upon receipt, the Customer must check the conformity and condition of the Products:

- Visibly damaged package ➔ open in the presence of the delivery driver;
- Damaged product ➔ refuse delivery with the note "Refused due to damage" on the delivery slip.

Any apparent anomaly must be reported to Customer Service as soon as possible in order to preserve claims against the carrier and, if applicable, initiate the return procedure described in Article 10.

8.5 Absence / failure to collect

In the event of absence, a delivery notice will specify how to collect the package or schedule a redelivery.
If the Customer does not collect the package within the carrier's timeframe, it will be returned to L&L4S; the Seller may refund the price (excluding initial shipping costs, which remain the responsibility of the Customer) or reship the package at the Customer’s expense.

8.6 Unavailability after Ordering

If a Product becomes unavailable (supplier shortage, production halt), L&L4S will:

- inform the Customer by email;
- offer a new delivery date or an equivalent Product;
- provide a refund within fifteen (15) days in case of refusal.

ARTICLE 9 – COMPLIANCE · WARRANTIES · RIGHT OF WITHDRAWAL · MEDIATION

9.1 Product Conformity

9.1.1 Pre-contractual information

Product data sheets (photographs, technical specifications, descriptions) are provided by the manufacturers. In accordance with Article L111-1 of the Consumer Code, L&L4S provides the essential characteristics, the price including taxes, the identity and contact details of the seller, as well as warranty terms. Slight variations in appearance may exist between the screen display and the actual Product for technical reasons (lighting, color calibration). Before shipment, each Product is checked to verify its conformity with the description.

9.1.2 Applicable legal warranties

Legal warranty of conformity (Art. L217-3 to L217-14 of the Consumer Code): the seller is liable for any lack of conformity occurring within two years of delivery. After repair, this period is extended by six months; after replacement, it starts again for two years (Art. L217-13).
Warranty against hidden defects (Art. 1641 of the Civil Code): the buyer may choose between cancellation of the sale or a price reduction.

9.1.3 Implementation

The Customer must contact Customer Service (support@eclairagefrancais.fr) and attach the order number and photos. After being assigned a return authorization number, Products must be returned in their original packaging; return shipping costs are advanced by L&L4S if the defect is confirmed. Detailed steps are provided in Article 9.3 and Annex 1 (warranty table).

9.2 Right of withdrawal (Consumer Customers)

9.2.1 Period and scope

The Customer has a right of withdrawal of 30 days (instead of the legal period of 14 days) starting from the day after the receipt of their Order. Products made to custom specifications or clearly personalized are excluded (Art. L221-28 3°).

9.2.2 Procedures

Notification by any means (e-mail: support@eclairagefrancais.fr or form in Annex 2).
Return in the original packaging; return costs are borne by the Customer (bulky items ≤ €100).
Refund of price + standard delivery within 30 days after receipt or proof of shipment.

9.3 Return procedure for defect / non-conformity

1. Contact support@eclairagefrancais.fr with photos and order number.
2. Receipt of a return authorization number.
3. Return to: L&L4S – Service Retours, 54-56 Rue de la Convention, 94270 Le Kremlin-Bicêtre.
4. Product must be complete, clean, and protected; after inspection: repair, exchange, or refund.

ARTICLE 10 – PRODUCT TERMS OF USE

10.1 Prior to any Order, the Customer shall review the information available on the Product sheet (description, dimensions, light sources, IP rating, components, any PDF manuals) and verify the compatibility of the Product with the intended use or installation (type of room, indoor/outdoor environment, electrical standards, etc.).

10.2 The Customer undertakes to strictly follow the manufacturer's recommendations: assembly diagram, tightening torque, type of bulb or LED source, supply voltage, maximum power ratings, maintenance conditions. Any non-compliant use, modification of the wiring, or connection to an unsuitable installation shall exclude the liability of L&L4S and may result in the loss of warranty coverage.

10.3 For any additional technical questions, Customer Service (support@eclairagefrancais.fr) is at the Customer's disposal to provide 2D/3D files, IES files, or installation advice.

ARTICLE 11 – LIABILITY

11.1 The Products sold by L&L4S comply with current French legislation and standards. The Customer remains solely responsible for compliance with the laws of the destination country: it is their responsibility to check, before placing any Order, for any potential restrictions on the import, installation, or use of the lighting fixtures.

11.2 The service provided by L&L4S is limited to the supply of the Products under the conditions stipulated in the T&Cs. User manuals, installation or maintenance advice are provided by the manufacturers; L&L4S cannot be held liable for their content or for how they are used.

11.3 L&L4S is only liable for direct, certain, and foreseeable damages resulting from a proven fault on its part. Excluded are:
– indirect damages (loss of business, profit, data, reputational damage);
– damages related to improper installation, technical incompatibility, or use not in accordance with the manufacturer's instructions.

For professional Customers, L&L4S's maximum liability is capped at the total amount (including taxes) of the Order.

L&L4S shall not be held liable when the non-performance or improper performance of the contract results from:
(a) a fault of the Customer;
(b) the unforeseeable and unavoidable act of a third party;
(c) a case of force majeure within the meaning of Article 1218 of the Civil Code (an external, irresistible, and unforeseeable event).

11.4 External links and the Internet.

Pages on the Site may contain links to third-party sites; L&L4S exercises no control over their content and declines all liability regarding any damages that may result from visiting them.
The Customer acknowledges the limitations of the Internet: L&L4S does not guarantee service continuity or the absence of errors or interruptions related to the network, service providers, or the Customer's equipment.

11.5 Global access.

The Site is accessible from any country, provided there is Internet access and compatible equipment. The Customer agrees to comply with public policy rules and local regulations from where they are accessing the Site.

ARTICLE 12 – PERSONAL DATA PROTECTION

Personal data provided by the Client when creating their account, placing and tracking an Order are collected and processed by L&L4S in compliance with Regulation (EU) 2016/679 "GDPR" and the amended Data Protection Act.

Main purposes:

- performance of the contract (Order management, invoicing, delivery, after-sales service);
- commercial prospecting (newsletters, personalized offers) based on consent (B2C) or legitimate interest (B2B);
- compliance with legal obligations (accounting, fraud prevention).

Client rights: access, rectification, erasure, objection, restriction, portability, and definition of post-mortem directives (Art. 12-22 GDPR). These rights may be exercised by email: support@eclairagefrancais.fr.

Main subcontractors: Stripe (payment), Shopify (hosting), Trustpilot (reviews), Klaviyo (e-mailing). Data remains hosted in the EU or in countries benefiting from an adequacy decision, or is governed by standard contractual clauses.

ARTICLE 13 – ACCOUNT SUSPENSION AND TERMINATION

13.1 Termination at the Customer's initiative

The Customer may request the permanent closure of their account at any time, provided that no Orders are currently being shipped or processed. Simply send an email to: support@eclairagefrancais.fr. Effective deletion occurs within a maximum period of 30 days, excluding retention required by regulations (accounting, legal warranties, proof).

13.2 Suspension or termination by L&L4S

L&L4S reserves the right to:

  • suspend access to the account; or
  • terminate the account and cancel ongoing Orders (with a refund of sums collected),

when the Customer:

– commits a payment incident or fraud (rejected payment, abusive use of chargebacks);
– publishes illicit content (hate speech, defamation, violation of third-party rights) in reviews or comments;
– uses the Site in a manner that compromises the security or integrity of the service;
– seriously breaches the General Terms and Conditions or applicable law.

The measure will be notified to the Customer by email, indicating the reason and, except in cases of urgency or fraud, a deadline to submit any observations.

13.3 Refusal of subsequent Orders

For legitimate reasons (existing dispute, proven fraud, repeated payment incidents), L&L4S may refuse to fulfill a new Order from a previously defaulting Customer, in accordance with Article L121-11 of the Consumer Code.

The suspension or closure of the account does not affect:
– legal warranties still applicable to Products already delivered;
– financial obligations incurred before the closure date.

ARTICLE 14 – INTELLECTUAL PROPERTY

All content published on the Website — sounds, images, photographs, videos, texts, animations, programs, graphic charter, databases, software, and underlying technologies — is protected by the Intellectual Property Code and remains the exclusive property of L&L4S or its partners who hold the rights.

The name "L&L4S", the Éclairage Français logo, as well as all trademarks, illustrations, images, or logotypes appearing on the Products, accessories, or packaging (whether registered or not) are and remain the exclusive property of L&L4S, with the exception of the visuals, trademarks, and logos belonging to the manufacturers presented on the Site.

Any reproduction, representation, adaptation, or use, whether total or partial, of these elements — by any means, on any medium, and for any purpose whatsoever — is strictly prohibited without the prior written authorization of L&L4S or the rights holder.

The creation of a hypertext link to the home page or any other page of the Site is subject to the prior and express authorization of L&L4S. Any request must be sent to: support@eclairagefrancais.fr.

ARTICLE 15 – WEEE ECO-CONTRIBUTION AND 1-FOR-1 TAKE-BACK

15.1 WEEE eco-contribution

All light fixtures sold by L&L4S include the eco-contribution relating to Waste Electrical and Electronic Equipment (WEEE).
This contribution is paid in advance by authorized manufacturers or importers and is included in the price inclusive of tax passed on to the Customer. The unit amount is indicated on the invoice or provided upon simple request.

15.2 Free take-back of a used device

In accordance with articles R543-180 et seq. of the Environmental Code, L&L4S offers the free take-back of an equivalent used light fixture upon the purchase of a new device ("1-for-1 take-back").
The Customer must express their wish at the time of ordering; the take-back takes place directly at the delivery location when the package is handed over.

ARTICLE 16 – MISCELLANEOUS PROVISIONS

16.1 Partial invalidity

If any of the provisions of the T&Cs were to be declared null, illegal or unenforceable by a competent court, the other provisions would retain their full validity and scope.

16.2 Proof and archiving

The computerized records kept in L&L4S's systems under reasonable security conditions shall be considered as evidence between the parties: orders, payments, electronic communications. Emails exchanged have probative value, unless proven otherwise by the Customer.

16.3 Waiver

The fact that L&L4S does not avail itself, at a given time, of any of the clauses of the T&Cs cannot be interpreted as a waiver to avail itself of them later. Any waiver is only valid if in writing and signed by the party concerned.

16.4 Force majeure

The performance of L&L4S's obligations (particularly delivery) is suspended in the event of force majeure within the meaning of Article 1218 of the Civil Code: war, riot, insurrection, external strike, pandemic, natural disaster, cyber-attack, interruption of transport or supplies.
L&L4S will inform the Customer within seven (7) business days following the occurrence of the event. If the suspension exceeds fifteen (15) calendar days, the Customer may cancel the relevant Order and will be refunded for the sums paid (price of the Products and standard delivery charges).

ARTICLE 17 – APPLICABLE LAW AND DISPUTE RESOLUTION

These General Terms and Conditions of Sale are governed by French law. Only the French version shall prevail.

In the event of a difficulty related to an Order, the delivery of a Product or, more broadly, the performance of the contract, the Customer is invited to first seek an amicable solution; they may in particular contact the FEVAD Mediator mentioned in Article 9.4.

The provisions of Articles 11 to 15 (liability, intellectual property, WEEE, etc.) also apply to any visitor or user of the Site who has not placed an Order.

APPENDIX – PROCEDURES FOR THE IMPLEMENTATION OF LEGAL GUARANTEES

Information box in accordance with articles L.217-3 to L.217-32 of the Consumer Code and 1641 et seq. of the Civil Code

The consumer has a period of two (2) years from the delivery of the goods to enforce the legal guarantee of conformity in the event that a lack of conformity appears.
During this period, the consumer only has to prove the existence of the defect—not the date of its appearance.

When the sale provides for the supply of digital content or a digital service on a continuous basis for more than two years, the guarantee applies to that content or service for the entire duration of the planned supply; the consumer still only has to prove the existence of the lack of conformity.

The seller is required to provide all updates necessary to maintain the conformity of the goods.

The consumer is entitled, at no cost and without major inconvenience, to the repair or replacement of the goods within thirty (30) days of their request.
This period may be extended when it concerns a custom-made lighting fixture that cannot be repaired quickly.

If the goods are repaired, the guarantee is extended by six (6) months.
If the seller mandates replacement rather than repair, the guarantee is renewed for two (2) years from the date of replacement.

The consumer may demand a price reduction or the rescission of the contract (full refund in exchange for the return of the goods) if:

  • the seller refuses to repair or replace;
  • the restoration to conformity exceeds 30 days;
  • the repair or replacement causes a major inconvenience (final removal, collection, or installation costs);
  • the lack of conformity persists despite the attempt to restore conformity.

The consumer may also immediately obtain a reduction or rescission if the defect is sufficiently serious to warrant it; they are then not required to request repair or replacement first.
Rescission is not possible if the defect is minor.

Any period during which the goods are out of service suspends the guarantee until they are restored to working order.

The rights above result from articles L.217-1 to L.217-32 of the Consumer Code.
A seller who obstructs the guarantee in bad faith is subject to a civil fine of up to €300,000 or 10% of the average annual turnover (art. L.241-5).

The consumer also benefits from the legal guarantee against hidden defects (art. 1641 to 1649 of the Civil Code) for two (2) years from the discovery of the defect; they may choose between a price reduction or the rescission of the sale.
